Lady lawyer rejects Senator Manny Pacquiao’s statement re transfer of money from DOH to DBM is illegal in Karen Davila interview
It appears Senator Manny Pacquiao’s “feeling vindicated” mood is short-lived.
Atty. Trixie of the Luminous has taken to Facebook to rain on Senator Manny Pacquiao’s parade because he believed the corruption probe versus DOH is some sort of vindication after he was booed on social media for accusing the Duterte admin of being 2-3x corrupt compared to the previous admin.
In the ZOOM interview with Karen Davila, Senator Pacquiao said that the transfer of money from DOH to DBM is not in our Constitution, hence it is illegal.
Sa kanyang interview with Karen Davila today (https://www.youtube.com/watch?v=ZltknLaDPdY), sabi ni Sen. Manny Pacquiao na wala daw sa saligang batas ang pag transfer ng pera from the DOH to the DBM. Ang implikasyon niya ay illegal ito.
Was the Senator correct? No, according to Atty. Trixie of the Luminous.
A quick research by Atty. Trixie of the Department of Budget and Management showed that DBM is the agency tasked in electronic procurement of the government.
Tiningnan namin ang Department of Budget and Management. Ang procurement service nito o PS-DBM ang bumbili ng commonly used supplies para sa mga upisina ng gobyerno. Ito rin ang sangay ng ahensya na nangangasiwa sa PhilGEPS o Philippine Government Electronic Procurement System.
Ang PhilGEPS ang nag popost at nag administer ng electronic procurement. Dito ginagawa ang bidding sa mga providers ng goods o equipment para sa gobyerno, ano man ang sangay. Maari rin makiusap ang ilang mga ahensya ng gobyerno na ang serbisyo nito ang gamitin sa pag acquire ng supplies o equipment.
And here’s the part that should make Senator Pacquiao’s shoulder sink in disappointment because Atty. Trixie cited a law that allows the the transfer of money from DOH to DBM.
Hindi po ilegal ang pag lipat ng pera mula sa isang ahensya ng gobyerno tungo sa PS DBM (tulad ng sinasabi ni Sen. Manny) dahil allowed po ito sa Procurement Law at sa Letter of Instructions No. 755 Relative to the Establishment of an Integrated Procurement System for the National Government and its Instrumentalities) dahil binabayaran yung mga goods o equipment na ipina-bid sa sistemang ito.
Ang paraan na ito ay tungo sa pag execute ng RA 9184 o Government Procurement Law at ang Implementing Rules nito, Atty. Trixie explained.
